These Terms of Service (the "Terms") are a legal agreement between you and PDF Gen Pro. They govern your access to and use of the PDF Gen Pro website, application, APIs, software, and related services (collectively, the "Services"). "PDF Gen Pro," "we," "us," and "our" refer to PDF Gen Pro. "You" and "your" refer to the individual or entity using the Services.

By installing, downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.

1. Acceptance of these Terms

By creating an account, accessing the Services, or using any feature of the Services, you agree to these Terms and our Privacy Policy. If you are using the Services for an organization, you represent that you have authority to accept these Terms on its behalf. If you do not agree, you may not use the Services.

2. Eligibility and Accounts

You must be legally able to enter into a binding agreement to use the Services. You are responsible for providing accurate account information, keeping your credentials secure, and all activity carried out through your account. Notify us promptly if you believe your account has been accessed without authorization.

3. The Services

PDF Gen Pro provides tools for generating and converting PDF documents, including through API endpoints and developer documentation. We may update, improve, suspend, or discontinue all or part of the Services. We will use reasonable efforts to provide notice of material changes when practical, but we do not guarantee that any particular feature will remain available.

4. Your Content

You retain ownership of documents, files, data, text, templates, and other material that you submit to the Services ("Your Content"). You grant PDF Gen Pro a limited, worldwide license to host, process, transmit, and reproduce Your Content only as necessary to provide, maintain, and secure the Services, or as otherwise permitted by our Privacy Policy.

You represent that you have all rights and permissions needed for us to process Your Content and that its processing will not violate applicable law or any third-party rights. You are responsible for maintaining your own backups. We may remove or restrict access to content that violates these Terms or creates a security, legal, or operational risk.

5. Acceptable Use

You may not use the Services to:

  • violate any law, regulation, or third-party right;
  • infringe, misappropriate, or violate intellectual property, privacy, or other rights;
  • upload malware or interfere with the security, integrity, or operation of the Services;
  • probe, scan, or test the vulnerability of the Services without authorization;
  • reverse engineer, decompile, or attempt to discover source code or non-public APIs;
  • circumvent usage limits, access controls, or authentication measures; or
  • use the Services to create or distribute content that is unlawful, fraudulent, or harmful.

You must comply with the API documentation, rate limits, and technical requirements that apply to your use of the Services. We may throttle, suspend, or limit access to protect the Services and their users.

6. Fees and Trials

Paid features are billed according to the pricing presented at the time of purchase. You authorize us or our payment provider to charge applicable fees and taxes. Subscription plans renew automatically for successive billing periods unless canceled through the billing controls available in your account. Cancellation takes effect at the end of the current billing period unless stated otherwise at purchase. Unless required by law or stated otherwise at purchase, fees are non-refundable. Trial or free usage may be subject to limits and may be changed or ended at any time.

7. Intellectual Property

The Services, including their software, interfaces, documentation, branding, and underlying technology, are owned by PDF Gen Pro or its licensors and are protected by applicable intellectual property laws. These Terms grant you permission to use the Services; they do not transfer any ownership interest to you. Feedback you provide may be used by PDF Gen Pro without restriction or compensation.

8. Privacy and Security

Our Privacy Policy explains how we collect, use, disclose, and retain information in connection with the Services. We use administrative, technical, and organizational safeguards designed to protect information, but no service can be guaranteed completely secure. You are responsible for configuring your account and integrations appropriately and for protecting credentials and API keys.

9. Third-Party Services

The Services may interoperate with third-party products or services. Those products are governed by their own terms and policies. PDF Gen Pro is not responsible for third-party products, their availability, or their handling of your information.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." PDF GEN PRO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. You are responsible for reviewing and validating documents generated through the Services before relying on or distributing them.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PDF GEN PRO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PDF GEN PRO'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PDF GEN PRO FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100.

12. Indemnification

You agree to defend, indemnify, and hold harmless PDF Gen Pro and its affiliates, officers, employees, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Services, Your Content, your breach of these Terms, or your violation of law or third-party rights.

13. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, create risk for PDF Gen Pro or others, fail to pay applicable fees, or where required for legal or operational reasons. Upon termination, your right to use the Services ends immediately. Provisions that by their nature should survive termination, including ownership, disclaimers, limitations of liability, and indemnification, will survive.

14. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms and update the date above. Material changes may also be communicated through the Services or by email. Your continued use of the Services after revised Terms become effective means you accept the changes.

15. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to the Services are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. The state and federal courts located in Oregon have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction and venue in those courts.

16. General Terms

These Terms and the policies they incorporate constitute the entire agreement between you and PDF Gen Pro concerning the Services. If any provision is found unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our prior written consent; PDF Gen Pro may assign them in connection with a merger, acquisition, or transfer of assets. Our failure to enforce a provision is not a waiver.
